I'm sure using LEGO in commercial projects (such as photography, like this) is not permitted by LEGO. The point being, you aren't entitled to profit from LEGO's intellectual property. There's a reason greetings cards companies don't use photos of LEGO (which would sell by the bucketload).
I GUARANTEE someone will respond to this saying 'It's OK because it's only *photographs* of LEGO" and those people are wrong.
Unless of course, the photographer has explicit permission to use LEGO in his commercial venture.

Does the fair play brochure actually mention photography? I couldn't see it by scanning through.
What about No Starch Press books, and others, that are not licensed products, that contain photography of minifigs and other items of LEGO's IP?

As far as I am aware LEGO has not concerned itself with them, and these photos are not that different.

As it states on the website, The LEGO Group does not directly endorse or sponsor any of my art projects. Everything is done independently. With that said however, they are fully aware of me and my ventures. The official @LEGO social media profiles, follow my social media profiles. I've been in dialog with many high ranking employees, with whom I have had no problems. Last but not least, I've worked on a freelance basis as an educator on camps for the LEGO Foundation for five years.
So there's no need to worry on my behalf. :-)
